These terms are between you and AQELTech Ltd, registered in England and Wales, company number 10006599, at 82A James Carter Road, Mildenhall, Suffolk, IP28 7DE, United Kingdom.
Using this site
You may read it, print it and quote it with attribution. You may not copy it wholesale, scrape it, or present our work as yours. The case studies name real clients and describe real projects; the client logos and names belong to those clients, not to us.
Our services
Project work is quoted individually and the quotation is the agreement: it sets the scope, the price and the timetable, and this page does not override it. A quotation is an offer, not a contract, until we both accept it in writing.
Paying for it
Unless the quotation says otherwise, project work is billed in three parts:
- 50% when you accept the quotation, before work starts.
- 25% at the halfway point of the agreed scope.
- 25% on the delivery date.
Invoices are due on receipt at each of those points. Where an invoice goes unpaid we are entitled to statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and we would far rather talk to you than rely on it.
Software licences
Where you buy a licence through one of our sites, the licence is per website unless the product page says otherwise, and it entitles you to the releases published while it is current. A lapsed licence keeps what it already paid for and stops receiving new releases; it is not retrospectively withdrawn.
Cancellation and refunds
If you are buying as a consumer rather than for a business, you normally have 14 days to cancel a digital purchase, and that right ends once download has begun with your agreement. Business purchases are not covered by those rules.
Where we have taken a payment in error we refund it. Where a licence has been issued and used, we deal with it case by case rather than by rule.
What we do not promise
The site is provided as it is. We keep it accurate and we do not guarantee it is: prices, availability and timescales change, and a page is not an offer until we confirm it.
Accepting the work
When we deliver, you have 14 days to test what we delivered against the agreed scope and to tell us about anything that does not meet it. Anything that does not, we put right at no charge.
If you have not told us within those 14 days, the deliverable is accepted. Accepted means accepted as matching what was agreed. It does not mean you have given up a right you cannot give up.
If you put the work into live use before the 14 days are up, it is accepted from the day it goes live, because at that point it is doing the job it was built for.
Defects after acceptance
For 90 days after acceptance we will correct, free of charge, anything in the deliverable that does not work the way the agreed scope said it would. Tell us and we will fix it.
That correction is the remedy for a defect. After those 90 days, work on the deliverable is chargeable at our rates at the time, whether it is a defect, a change you want, or something a platform or a browser changed underneath it.
Liability
We do not accept liability beyond the acceptance and defect terms above. Once a deliverable has been accepted and its 90 day defect period has ended, our obligations in respect of that deliverable are complete.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude. If you are buying as a consumer rather than for a business, your statutory rights are unaffected and nothing on this page takes them away.
Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss, however it arises.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
